Terms of Service

These Terms and Conditions govern the use of the online store www.labeillejewelry.com, for which LABEILLE JEWELRY SL, Tax ID (CIF): B26656959, hereinafter "Labeille Jewelry", is legally responsible. By accepting them, the User declares that they have read, understand and fully comprehend what is set out herein and that they assume all of its obligations. If the User does not agree with the content of this document, they must leave this website and will not be able to access or use the services it offers. Likewise, the User expressly and unreservedly accepts that access to and use of this website, its services and the content of such services are carried out under the User’s sole and exclusive responsibility.


These Terms and Conditions shall be accepted by the parties without reservation and may be modified at any time and without prior notice. It is the User’s responsibility to read them when making a purchase or entering into a contract. The terms in force at the time the contract is concluded shall be those that apply.


Applicable regulations
This electronic contract is entered into under Spanish law and specifically under the legal framework established by Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE) and by Law 3/2014 of 27 March, General Law for the Protection of Consumers and Users (LGDCU).


The electronic contract will not be filed by a third party and the language used to conclude it is Spanish. These general terms and conditions may be stored and reproduced at any time by the user making a purchase, using their Internet browser options, and must be accepted before proceeding to pay for the order.


User account and error correction
To make online purchases in this store, you may register by creating a "User Account" or place a quick order without registering (as a guest user).


If you make a purchase as a guest, your personal data will not be stored on the website and you will not be able to check your order history. Your personal data will be kept only for the management and delivery of the products ordered.


If you decide to register, you will receive an email confirming that the process has been successful and reminding you of your login details. From your account you can make purchases, check your order history, change your password, modify personal data, change shipping and billing addresses, leave comments and carry out other procedures related to your purchases.


In addition, at any time you can access your private account to check your personal information and addresses and, if necessary, correct any errors that may have occurred when entering the data or update them. Shipping and billing addresses can also be corrected or updated throughout the checkout process.
You may unsubscribe at any time by sending an email, from the address you wish to unsubscribe, to info@labeillebisuteria.com, which will result in the deletion of your personal data.


In any case, the creation and cancellation of a user account shall be governed by the provisions of the Privacy Policy.

 

Purchase process
Shopping at "Labeille Jewelry" is easy and straightforward; you just have to follow these steps:

  1. Select the products you wish to purchase from those offered by "Labeille Jewelry". By clicking on each product, you will access its product page, which includes a detailed description with information, main features and price. If you need more information, please feel free to contact us. NOTE: In the case of product pages with photographs, the products may show slight variations in color or texture compared to the photograph displayed on the website, due to different factors, for example, your monitor’s resolution. However, we will do everything possible to ensure that the images are as true to life as possible.
  2. Once you have selected the product or products you wish to buy, you must click the "Add to cart" button; the product will then be added to your shopping cart. If you wish, you can continue adding more products to the cart or proceed directly to checkout.
  3. After selecting the products, a summary will appear identifying the selected item or items. Finally, to continue with your order, you must click the "Checkout" (or similar) button.
  4. As we indicated in previous sections, at the end of your purchase you have the option of registering or placing a quick order without registering (as a guest user). If you register, you must provide your contact information and address, and on your next purchases you will not have to re-enter your details.
  5. Finally, you must accept these Terms of Sale and choose the payment method from those offered by "Labeille Jewelry" (see the following section).
  6. Once the purchase process has been completed, we will send you an email detailing the purchase information, as well as a purchase receipt or invoice in digital format. If you do not receive this email within 24 hours, or if you notice any error in the data entered, please contact us by any of the following means:

Likewise, if you have not given your consent to receive the invoice in electronic format, you will receive a paper copy at no additional cost. Otherwise, you may revoke your consent by contacting us through any of the means mentioned above.

All data are processed directly by the bank, so that "Labeille Jewelry" can always offer maximum security, transparency and confidentiality in the transaction.


PayPal
Make your payment with your PayPal account. With this payment method, "Labeille Jewelry" never collects or handles any banking data. All data are processed directly by PayPal, so that "Labeille Jewelry" can always offer the highest level of transparency, security and confidentiality in the transaction.

 

Amazon Pay
Make your payment with your Amazon Pay account. With this payment method, "Labeille Jewelry" never collects or handles any banking data. All data are processed directly by Amazon Pay, so that "Labeille Jewelry" can always offer the highest level of transparency, security and confidentiality in the transaction.

 

Apple Pay
Make your payment with your Apple Pay account. With this payment method, "Labeille Jewelry" never collects or handles any banking data. Prices, taxes, duties and fees
Prices are expressed in euros. The prices of "Labeille Jewelry" products may vary, but any changes will not affect orders for which a shipping confirmation has already been sent.


The final price of the products purchased may vary depending on the taxes applicable in each case, or depending on the shipping address and the buyer’s profile (individual or business). For information purposes, and except for those activities not subject to or exempt from VAT, the following taxes will be applied to the items on our website:

  • The retail price (RRP) of items with a delivery address in mainland Spain and the Balearic Islands includes VAT in all cases.
  • The RRP of items with a delivery address in other EU countries, where the buyer is a natural person (consumer), includes VAT.
  • The RRP of items with a delivery address in other EU countries, where the buyer is a company or professional, does NOT include VAT provided they are registered in the Register of Intra-Community Operators (in which case they must provide us with a valid Tax Identification Number). If they are not registered as an intra-community operator, the RRP includes VAT.
  • The RRP of items with a delivery address in the Canary Islands or Ceuta and Melilla and, in general, in any non-EU country, does NOT include VAT, as the transaction is treated as an export. The price indicated for each item is its final price for shipments to these destinations. "Labeille Jewelry" will not be responsible for the Single Administrative Document (DUA) or for any import charges and taxes (ISPI, IGIC), fees or duties that may be generated at the destination customs office, where applicable.

 

Cancellation of account registration and service, termination and blocking
User accounts are not deleted due to lack of use. The User may unsubscribe by requesting it from the staff of

"Labeille Jewelry", by sending an email to administracion@labeillejewelry.com or through their account profile.


In the event of non-payment of an order, it may be temporarily suspended until the User resolves the non-payment situation. If more than 15 days have passed, "Labeille Jewelry" may proceed to cancel the order.


"Labeille Jewelry" reserves the right to block access to the User’s account without prior notice (or to delete the User’s account directly) if it is used unlawfully or in breach of the obligations and regulations set out herein, which will be communicated by email. Blocking or deleting the user account will have no effect on the obligation to pay for products purchased, where applicable.


In exceptional cases, at the sole discretion of the administrators of "Labeille Jewelry", and after assessing the seriousness of the matter, the administrators may choose to warn the offending User before permanently deleting or blocking their account.


By registering as a User, you agree that the owners of this site reserve the right, and may act at any time and without prior notice, to modify or discontinue this website and its services, or to delete the data provided, either temporarily or permanently.


Warranty
Except for those which, by their nature, are excluded from the consumer goods warranty regulations, and provided that the buyer makes private use of them, all our products are covered nationwide by a warranty against manufacturing defects for two years from the date of purchase (or the date of delivery, if later), or one year if the item is not new.


We will be liable for any lack of conformity, which the buyer must notify us of within two months of becoming aware of it.


If the defect or lack of conformity arises within the first 2 years from delivery of the item, it is presumed that the defect or lack of conformity already existed when the product was invoiced (or delivered, if later), that is, that there is an original or manufacturing defect in the product, unless we can prove that the defect or lack of conformity


Conversely, if the defect or lack of conformity arises after 2 years, there is no presumption that the defect originates from the factory.
In the event of a defective product, we may proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, procedures which will be completely free of charge for the buyer (including any transport costs, where applicable).


Therefore, defects and deterioration caused by external events, accidents, use not in accordance with our instructions or those of the manufacturer (misuse) or normal wear and tear are excluded from the warranty. Likewise excluded are products that have been modified or repaired by the customer or by any other person not authorized by "Labeille Jewelry", as well as products that are the subject of a specific contract. In such cases, the consumer must bear the cost of their repair.


By law, and unless proven otherwise, products shall be deemed to be in conformity with the contract provided that they meet all of the following requirements:

  1. They conform to the description made and possess the qualities of the product that we have presented to the consumer and user in the form of a sample or model.
  2. They are suitable for the uses to which products of the same type are normally put.
  3. They present the quality and performance which are normal in a product of the same type and which the consumer and user can reasonably expect, given the nature of the product.

 

Dispute resolution
As required by the new European regulations, we inform users of the existence of a European online dispute resolution platform for online contracting. Therefore, for the resolution of consumer disputes (in accordance with Art. 14.1 of Regulation (EU) 524/2013), the European Commission provides an online dispute resolution platform which is available at the following link.
